Trustees and executors also have the right to request instructions from the Probate Court, or they may be forced to defend petitions filed by beneficiaries. Litigation in Probate Court is often charged with emotions, whether as a result of strained relations or an abiding sense of distrust among those entitled to the distribution of an estate and those responsible for managing the distribution.

Beyond our ability to effectively litigate these issues in court, we find that our efforts to help beneficiaries and their fiduciaries rekindle some basis for trust in their working relationship can often solve their mutual problems and protect against future conflicts.
